Changes to the recruitment process for aided teacher posts.
Subject: Revision of Specific Provisions in the Andhra Pradesh Educational Institutions Rules, 1993 – Notification Issued – Orders Passed
ORDER:
The Government, in earlier orders referenced above, made amendments to Rule 12 and removed Rule 13 of the Andhra Pradesh Educational Institutions (Establishment, Recognition, Administration, and Control of Schools under Private Management) Rules, 1993. However, the Hon’ble High Court, in subsequent legal proceedings, struck down the amendments introduced via the second referenced Government Order, citing violations of fundamental rights under Article 30(1) of the Constitution of India.
Further, in another judgment, the High Court directed the authorities to fill vacancies in aided institutions based on G.O.Ms.No.1, Education Department, dated 01.01.1994, and in accordance with the framework laid out under Sections 19 and 25 of the Right of Children to Free and Compulsory Education Act, 2009.
In yet another related case, the Court invalidated proceedings in Rc.No.143/C2/2024 dated 19.03.2025, which directed aided institutions to adopt a Computer-Based Test (CBT) mechanism for recruitment. The Hon’ble Court ruled that such a system cannot be introduced through executive orders where it has previously been set aside.
In light of legal guidance and multiple requests from stakeholders seeking clarity on recruitment protocols for aided teaching positions, the Government has thoroughly reviewed the matter. Following this review, it has been decided to modify Rules 12 and 13 of the 1993 Rules, as they relate to the recruitment and appointment of teaching and non-teaching staff in private aided and unaided educational institutions.
These revised provisions shall apply to all relevant institutions, particularly where recruitment remains pending.
Accordingly, the following amendments will be published in an Extraordinary Edition of the Andhra Pradesh Gazette.
NOTIFICATION
In accordance with the powers granted under Section 99, read with Sections 20 and 21 of the Andhra Pradesh Education Act, 1982 (Act No. 1 of 1982), and in supersession of earlier amendments issued through G.O.Ms.No.43, School Education (PS) Department, dated 09.08.2018, and G.O.Ms.No.26, dated 16.02.2019, the Government hereby makes the following amendments to the Andhra Pradesh Educational Institutions Rules, 1993:
AMENDMENTS
1. Substitution of Rule 12 – Recruitment to Aided Posts in Non-Minority Institutions
Rule 12 – Appointment of Teaching and Non-Teaching Staff in Aided Posts (Non-Minority Institutions):

Recruitment shall adhere strictly to the Government-prescribed staffing structure and qualification standards.

All aided positions shall be filled through a Computer-Based Test (CBT), administered by a Staff Selection Committee, in alignment with these rules.

Vacancies must be advertised widely – at least in two high-circulation newspapers (one in Telugu) and through official online platforms of the Education Department.

Prior to recruitment, educational agencies must seek clearance from the competent authority confirming the absence of eligible surplus staff in the district. Such clearance requires Government approval.

Selection shall be merit-based with no interviews. The assessment will be for 100 marks: 80 through CBT and 20 from TET/CET scores. Candidates with prior experience in aided institutions will receive service-based weightage (0.5 marks per year, up to 5 marks).

Recruitment shall follow the same merit-roster process used for Government DSC teacher appointments.

Qualification and age criteria shall align with those used in Government or Local Body school appointments. A maximum three-year age relaxation will be extended to current aided school staff.

Appointments must be formally approved by the competent authority prior to finalization.
12-A – Recruitment in Un-Aided Posts (Non-Minority and Minority Institutions)

Appointments must follow Government staffing patterns and qualification criteria.

Selection will be made by a Staff Selection Committee constituted by the educational agency, following the prescribed procedures.

Recruitment notifications must appear in at least two prominent newspapers (including one Telugu daily) and online.

Clearance from the competent authority is mandatory before recruiting staff to aided posts. Government approval is necessary before such clearance is granted.

Minority institutions receiving government aid must also notify the Employment Exchange and call eligible candidates for interviews and written tests, provided they are registered in a state Employment Exchange.

A nominee from the Education Department, not below the rank of Deputy Educational Officer, must participate in selection committees of aided minority institutions. Absence of the nominee does not invalidate the selection if a valid explanation is provided.

Communal roster rules apply to all private institutions, except minority institutions hiring from within their community. If an SC/ST slot is filled with a minority candidate, the roster point shall be carried forward.

Un-aided posts may be filled contractually, provided the candidate meets the required qualifications. Any disputes arising from such contracts are to be resolved in civil courts or Educational Tribunals.

Competent authority approval is required for all appointments. Institutions must notify the authority within a month and follow up if approval is delayed.

Appointments shall only be made upon receiving said approval.

Temporary appointments to unaided posts are permissible in casual vacancies, provided they do not exceed 60 days.
2. Substitution of Rule 13 – Constitution of Staff Selection Committee
Rule 13 – Staff Selection Committee for Aided Post Appointments (Excluding Promotions):

The Committee shall include:

The President of the educational agency or their nominee;

The Headmaster of the institution;

Two subject experts from a DEO-approved panel (at least one being a Headmaster of a recognized school);

An officer of the Education Department not below the rank of Deputy Educational Officer, nominated by the DEO.

The President of the educational agency may act as the Chairperson or nominate another Committee member for the role.

A quorum of four members is required for meetings, and the DEO nominee’s presence is mandatory.
